In short
- We sell travel plans for China as PDF files. We do not sell flights, accommodation, tours or insurance.
- You organise your trip yourself. You make contracts with airlines, hotels and insurers directly with them.
- The airline is responsible for flight changes and cancellations. Your passenger rights come from your contract with the airline and from Regulation (EC) No 261/2004.
- The European Health Insurance Card (EHIC) does not work in China. Buy travel insurance that covers medical costs before you go.
- Once a ready-made plan has been delivered, it cannot be returned: by buying with instant delivery you agree to it and lose your right of withdrawal. You can, however, always make a complaint if the plan does not arrive or does not match its description.
§ 1. Who we are
- The time4china website, available at https://time4china.com (time4china.pl redirects to this address) (the “Website”), is run by time4china as an unregistered business activity (Article 5(1) of the Polish Act of 6 March 2018 – Entrepreneurs’ Law) (the “Service Provider”, “we”).
- Contact (also our correspondence address): e-mail contact@time4china.com or kontakt@time4china.pl.
- These Terms set out the rules for using the Website, concluding contracts for the supply of travel plans and making complaints. They are the terms referred to in Article 8 of the Polish Act of 18 July 2002 on the provision of electronic services.
- These Terms are available free of charge on the Website. You can download, save and print them (e.g. using your browser’s “Print” function).
§ 2. Definitions
- Customer: a natural person, legal person or organisational unit that uses the Website or concludes a contract with us.
- Consumer: a natural person who concludes a contract with us that is not directly related to their business or professional activity (Article 221 of the Polish Civil Code).
- Entrepreneur with consumer rights: a natural person running a sole proprietorship who concludes a contract directly related to that business but not of a professional nature for it, in particular in view of the business activity entered in the Polish business register (CEIDG). They have the consumer rights described in § 8 and § 9.
- Plan: a ready-made travel plan in PDF format (digital content not supplied on a tangible medium), containing, among other things, a daily schedule, a description of the route, connections and transport, addresses and a list of places. Each Plan is described on the Website.
- Bundle: several Plans sold together for one price (e.g. “All travel plans”), as listed in the Bundle's description on the Website; the “All travel plans” Bundle includes the Plans available on the Website on the date of purchase. Plans in a Bundle are made available on a single download page. The provisions of these Terms concerning a Plan apply to each Plan in a Bundle.
- Custom Plan: a travel plan prepared individually based on information provided by the Customer, to the extent and by the date set out in the accepted quote. A Custom Plan is the plan only: it does not include a consultation, the selection of flights, trains and accommodation or instructions for booking them, or contact and assistance during the trip – these services are included in the Premium Package.
- Premium Package: a Custom Plan extended with an online consultation before the trip, the selection of flights, trains and accommodation together with instructions on how to book them yourself, and remote contact and assistance during the trip (messages, e-mail, online calls), to the extent and for the period set out in the accepted quote. You make the bookings and payments yourself, directly with the carriers and accommodation providers (§ 3(2)). It does not include in-person assistance or accompanying you in China. The Premium Package is not a Bundle within the meaning of point 5; the provisions of these Terms concerning the Custom Plan apply to it accordingly.
- Durable medium: a material or tool that allows information to be stored and reproduced unchanged, e.g. an e-mail or a PDF file.
§ 3. What we sell and what we do not
- We sell information content and related advisory services only, i.e. Plans, Custom Plans and the Premium Package. A Plan is a suggested route and a collection of practical information that you use when organising your trip yourself. In the Premium Package we recommend specific connections and accommodation and show you how to book them, but we do not book or pay for them on your behalf.
- We are not a tour operator or a trader facilitating linked travel arrangements within the meaning of the Polish Act of 24 November 2017 on package travel and linked travel arrangements. We do not sell, and do not act as an intermediary in the sale of:
- air, rail or other transport tickets,
- accommodation, car hire, optional excursions or admission tickets,
- insurance (we are not an insurance agent within the meaning of the Polish Act of 15 December 2017 on insurance distribution).
- If a Plan describes a flight, journey or accommodation, this is for information only and is a suggestion. The price of a Plan does not include any transport, accommodation or insurance services. You buy these services yourself, directly from carriers, hotels, insurers or other sellers, on their terms.
- For this reason you do not have the rights of a traveller under the package travel legislation against us (e.g. under a tour operator’s insurance guarantee or the Polish Tourist Guarantee Fund). The third parties from whom you buy services are responsible for providing them.
§ 4. Services on the Website and technical requirements
- On the Website we provide free of charge: browsing descriptions, maps and photos, a contact form and an order form, as well as the time4china app (the page /aplikacja/, which you can add to your phone's home screen) for viewing purchased Plans, also without internet access. A contract for these services is concluded when you start using them and ends when you leave the Website, send a message or remove the Plans from the app. You can stop using them at any time.
- Account. When you buy through Stripe, we assign the purchased Plan to the e-mail address entered at checkout – you do not need to register or set a password. In the time4china app and on the website you sign in with a one-time code sent to that address and can access your purchased Plans on every device. A Plan bought with another e-mail address can be added to your account in the app with its plan key (point 3). The account service is free of charge; the contract for it lasts until the account is deleted, which you can request at any time with the “Delete account” button in the app or by writing to us. Deleting the account does not take the Plan away from you – you can still open it with the key from the e-mail sent after purchase. Do not share your sign-in code with others.
- Plan key. Every purchase through Stripe comes with a personal key (12 characters, e.g. ABCD-EFGH-JKLM) – in the e-mail sent after purchase and on the download page. The key opens the Plan’s download page and adds the Plan to the time4china app; the buttons in the e-mail enter it for you, and your browser and the app remember it. One key opens the Plan on up to 6 devices or browsers, and PDF files can be downloaded with it up to 30 times a day. The key is meant for you and the people travelling with you (§ 14) – do not share it publicly. If you run out of devices or the key reaches third parties, write to us: we will unlock the key or issue a new one and deactivate the old one. A Plan already saved on your device or downloaded as a PDF stays with you. The Plan’s PDF files (downloaded from the download page or the app, or sent by e-mail) carry a mark at the bottom of each page with your name (or a shortened e-mail address) and the order number – the Plan is for your personal use (§ 14).
- To use the Website you need a device with internet access and an up-to-date browser (e.g. Chrome, Firefox, Safari, Edge) with JavaScript enabled; to receive a Plan you need an e-mail account and a program that opens PDF files. The time4china app works in up-to-date browsers on Android and iOS phones; Plans saved in it take up space in the device's storage.
- The order form sends a message to our mailbox. After sending, you will see a confirmation on the page and receive an automatic confirmation at the e-mail address you provided, and our reply will be sent to the same address.
- You must not send unlawful content through the Website, including content that infringes the rights of third parties.
- Using the internet involves typical risks such as malware or phishing. We recommend an up-to-date operating system, browser and antivirus software. We never ask for passwords or card details by e-mail.
- Complaints about how the Website works can be made under § 9.
§ 5. Ordering and concluding the contract
- To order a Plan, choose a variant on the Website, fill in the order form and send the message, or e-mail us with the name of the variant.
- We will reply by e-mail with a confirmation stating: the name of the Plan, the price, the method and deadline for payment, the delivery date and information about the right of withdrawal.
- The contract is concluded when you pay after receiving the confirmation. The contract consists of: the description of the Plan on the Website, the order confirmation and these Terms.
- Instant purchase. A ready-made Plan marked on the Website with a “Buy now” button can be bought without waiting for a confirmation: you tick the required consents, go to the payment page of the payment operator Stripe (Stripe Payments Europe, Limited, Ireland) and pay. The contract is concluded at the moment of payment. Immediately after payment you will be redirected to a page from which you can download the Plan, and we will send a confirmation of the contract (including confirmation of your consent referred to in § 8(2)), your personal plan key (§ 4) and a link to download the Plan to the e-mail address you entered at checkout. If you want to change the route of a ready-made Plan, please use the order form (point 1).
- Custom Plan and Premium Package: after receiving your information (dates, number of days, budget, interests) we will send you a quote with the scope of work and the delivery date. The price of a Custom Plan depends on the number of places on the route, according to the price list on the Website; the price of the Premium Package depends on the scope (length of the trip, number of places and travellers) and is not lower than the “from” price shown on the Website. The price in the quote is binding. The contract is concluded when you accept the quote by e-mail.
- Contracts are concluded in Polish. At your request we also correspond in English.
§ 6. Prices and payment
- Prices on the Website are gross prices in Polish złoty (PLN) and are final prices. The Service Provider is exempt from VAT under Article 113(1) of the Polish VAT Act.
- The Website may also show prices in euro (EUR), US dollars (USD), British pounds (GBP) and Chinese yuan (CNY, RMB). These amounts are indicative only, converted at the average exchange rate of the National Bank of Poland (or an approximate rate when the NBP rate is unavailable). The price in PLN is binding and you pay in that currency. Any currency conversion costs charged by your bank are outside our control.
- You can pay through the payment operator Stripe (payment card, BLIK, Apple Pay, Klarna) or by bank transfer to the account stated in the order confirmation.
- The payment deadline is stated in the order confirmation. If you do not pay by that deadline, the order will be cancelled.
- If we reduce the price of a Plan, we will show the lowest price from the 30 days before the reduction next to the reduced price.
- You enter a discount code on the payment page. Next to each code we state the discount and what it applies to (e.g. a code for your next Plan does not apply to Bundles). The discount is calculated from the regular price; codes cannot be combined or exchanged for cash.
- At your request we will issue a receipt (rachunek). As a VAT-exempt seller we do not issue VAT invoices.
§ 7. Delivery of the Plan
- We deliver Plans as a PDF file or a download link. With an instant purchase (§ 5(4)) the Plan is available for download immediately after payment, and we also send it automatically to the e-mail address given at checkout, together with a confirmation of the contract and your personal plan key (§ 4). With an order made through the form, we send it to the e-mail address given in the order without undue delay after the payment has been credited, and no later than within 24 hours.
- We deliver Custom Plans, and perform the Premium Package services, by the dates given in the accepted quote.
- Each Plan states the date of its last update. The information is correct as of that date.
- If you do not receive the Plan on time, check your spam folder and write to us. If, despite your request, we do not deliver the Plan without undue delay, you can withdraw from the contract and receive a full refund.
§ 8. Right of withdrawal
This section applies to Consumers and Entrepreneurs with consumer rights.
- You can withdraw from the contract without giving any reason within 14 days of its conclusion.
- Ready-made Plan (digital content). You do not have the right of withdrawal if, before the Plan was supplied:
- you expressly agreed to the Plan being supplied before the end of the 14-day period,
- you were informed that you would lose the right of withdrawal once the Plan is supplied and you acknowledged this,
- you received confirmation of this consent from us on a durable medium (e-mail)
- Custom Plan and Premium Package (services). If you ask us to start work before the end of the 14-day period and then withdraw from the contract, you will pay for the part of the work done up to the time of withdrawal. The right of withdrawal expires once we have fully performed the service, if before it started you expressly consented to this and were informed that you would lose this right (Article 38(1)(1) of the Polish Consumer Rights Act).
- To withdraw from the contract, send us a clear statement, preferably by e-mail. You can use the model form in the annex, but you do not have to. It is enough to send the statement before the deadline expires.
- We will refund all payments without undue delay and no later than 14 days after receiving your statement, using the same payment method, unless you expressly agree to another one. You will not incur any fees as a result.
- After withdrawing from the contract you may not use the Plan or share it with others.
- No returns after a ready-made Plan has been delivered. A ready-made Plan delivered in accordance with point 2 cannot be returned, and its price is not refundable on the grounds of withdrawal from the contract, cancellation of the trip, a change of plans or a change or cancellation of a flight (§ 11). This does not limit your statutory rights: if the Plan is not delivered (§ 7(4)) or does not conform to the contract (§ 9), you are entitled to a refund or a price reduction as provided by law.
§ 9. Complaints and conformity of the Plan with the contract
- We are liable for the conformity of the Plan with the contract under Chapter 5b of the Polish Consumer Rights Act and, towards Customers who are neither Consumers nor Entrepreneurs with consumer rights, under the Polish Civil Code, subject to § 13(5).
- We are liable for any lack of conformity of the Plan with the contract that existed at the time of delivery and becomes apparent within two years of that time.
- A Plan does not conform to the contract, for example, when it does not contain elements promised in its description, the file does not open, or the information was already incorrect on the update date stated in the Plan.
- Send complaints to contact@time4china.com or kontakt@time4china.pl. Describe what the complaint concerns, what the problem is and what you expect.
- We will reply within 14 days of receiving the complaint. If a Consumer does not receive a reply within this period, the complaint is deemed to have been accepted.
- In the event of non-conformity, you can request that the Plan be brought into conformity with the contract (e.g. corrected or completed). If we do not do this within a reasonable time, the non-conformity is significant, or it persists despite our attempt to fix it, you can request a price reduction or withdraw from the contract (for an insignificant non-conformity you are only entitled to a price reduction).
- Changes to prices, timetables, opening hours or admission rules made by third parties after the update date of the Plan do not mean that the Plan does not conform to the contract. If you notice such a change, let us know – we will update the Plan and send you the current version.
§ 10. Travel insurance and health
- The Plan does not include insurance. We do not sell insurance, do not advise on choosing a particular insurer and do not act as an intermediary in concluding insurance contracts.
- We strongly recommend that before you travel you buy travel insurance covering at least:
- medical costs abroad, with a high sum insured,
- assistance and medical transport, including repatriation home,
- personal accident and personal liability,
- optionally: baggage, flight or baggage delays, cancellation and curtailment costs.
- Check in the policy terms whether it covers activities in the Plan, e.g. trekking and mountain trips (some routes go above 3,000 m, e.g. Mount Emei, and Jiuzhaigou lies at 2,000–3,100 m), and your chronic conditions.
- Before you travel, consult a travel medicine doctor, ideally 6–8 weeks in advance, about vaccinations, prevention and the medicines you take. Also check whether your medicines can legally be brought into China.
- Health information in the Plan (e.g. about altitude, climate, food or water) is general in nature. It is not medical or insurance advice and does not replace a consultation with a doctor or insurer.
- You choose the type and scope of insurance yourself. We are not responsible for the consequences of having no insurance or choosing an insufficient policy.
§ 11. Flight changes, delays and cancellations
- We are not a party to the contract of carriage. You buy tickets directly from the airline or another seller. The airline is responsible for schedule changes, delays, cancellations, denied boarding and baggage.
- Your rights as a passenger come from your contract with the airline and from Regulation (EC) No 261/2004. As a rule, the Regulation covers:
- flights departing from an airport in the European Union (e.g. from Budapest to China), regardless of the airline,
- flights from an airport outside the EU (e.g. the return from Chongqing) to the EU only if operated by an EU airline.
- A change, delay or cancellation of a flight, or cancellation of the trip, does not affect the contract for the Plan and does not in itself entitle you to a refund of the Plan price. This does not limit your rights under § 8 and § 9.
- If your flight is rescheduled or cancelled, write to us. Where possible, we will advise you free of charge on how to adjust the order of days in the Plan to the new times. A thorough rework of the route is carried out as a Custom Plan under a separate quote.
- We recommend: accommodation and transport bookings that can be changed or cancelled free of charge, a time buffer between arrival and onward journeys, and – with tickets for separate flights – awareness that the airline of the first flight is usually not responsible for you missing the next one. Consider insurance against cancellation, curtailment and flight delay costs.
§ 12. Entry to China and safety
- You are responsible for having a valid passport, visa or meeting the visa-free entry conditions, as well as for the documents of other travellers. Entry rules for China change. Before you travel, check them with your country’s foreign ministry (for Polish citizens: gov.pl) and with the embassy or consulate of the People’s Republic of China.
- We recommend registering your trip with your government’s travel registration service (for Polish citizens: Odyseusz).
- While travelling, obey local law, national park rules and instructions from the authorities. Some attractions (e.g. glass bridges, cable cars, mountain trails) may be closed due to weather or require advance booking.
§ 13. Liability
- We prepare Plans carefully, based on our own experience and available sources, as of the update date stated in the Plan.
- We are not responsible for the acts or omissions of third parties, in particular airlines, hotels, attractions, insurers and public authorities, or for changes they make after the update date of the Plan.
- You make decisions about your trip, including the choice of services, dates and activities, yourself, taking into account your health, fitness and current conditions.
- Towards Consumers and Entrepreneurs with consumer rights, the provisions of this section do not exclude or limit liability provided for by mandatory provisions of law.
- Towards other Customers, our liability is limited to the price paid for the Plan in question and does not cover lost profits. This limitation does not apply to damage caused intentionally.
§ 14. Copyright
- The Plans, texts, maps and our own photos on the Website are protected by copyright.
- When you buy a Plan, you receive a non-exclusive, non-transferable licence to use it for your own personal purposes, including by the people travelling with you, without time or territorial limits. You may save the Plan on your devices and print it.
- Without our consent you may not share the Plan publicly, resell it or distribute it in whole or in part.
- Some photos on the Website come from Wikimedia Commons and are used under the licences indicated with each photo.
§ 15. Dispute resolution
- If something goes wrong, write to us – we will try to resolve the matter amicably.
- Consumers can use out-of-court complaint and redress procedures, e.g. the help of a district (municipal) consumer ombudsman, a regional Trade Inspection office or consumer organisations in Poland. Information is available at prawakonsumenta.uokik.gov.pl. Consumers from other EU countries can contact the European Consumer Centres Network.
- Using these procedures is voluntary. We do not undertake to participate in out-of-court dispute resolution.
- Disputes are settled by the competent common courts in accordance with the Polish Code of Civil Procedure.
§ 16. Final provisions
- Contracts are governed by Polish law. This choice of law does not deprive Consumers of the protection afforded to them by the mandatory provisions of the law of the country of their habitual residence.
- We may change these Terms for important reasons, in particular changes in the law, payment methods or the scope of services. We will announce any change on the Website at least 14 days before it takes effect. Contracts concluded before the change are governed by the previous version of the Terms.
- Our Privacy Policy explains how we process personal data.
- These Terms are effective from 10 October 2026.
